By purchasing goods from allinone.co.uk (Site) or All-In-One Garden Centre Ltd (company) you enter a legal and binding agreement with us on the following terms. You should read and understand these terms because they affect your rights and liabilities.
These terms describe the basis for purchase by you and the sale by us of the products described on this website.
1.Terms & Conditions
1.1. By placing an order for goods from All-In-One Garden Centre Ltd (the ‘company’) through our website “allinone.co.uk” and either collecting the goods you have ordered at our store or by us delivering them to you then you enter a legal and binding agreement with us on the following terms set out below. You should read and understand these terms because they affect your rights and liabilities.
1.2. These terms set out the basis of any purchase by you and sale by us of the goods described on this website.
2. Definitions and Interpretations
2.1. In these terms the following words have the following meanings:
2.1.1. Contract: the contract for the sale and the purchase of the goods
2.1.2. Goods: the range of products available for purchase from our site in accordance with these terms.
2.1.3. Site: our presence on the world-wide web, currently accessible via the address www.allinone.co.uk
2.1.4. Seller, we, our or us: All-In-One Garden Centres Ltd, Company Number 1630338, Registered Office: All-In-One Garden Centre Ltd, Rochdale Road, Middleton Manchester, UK, M24 2RB. VAT No 145 6991 33
2.1.5. "You" and "Your" means the person ordering goods from us, who must be over 18 years of age.
3.1. To order from our site you must register with us.
3.2. To register you must be over 18 years of age, live in the UK, and have a UK bank issued credit or debit card acceptable to us in your name and provide us with the same address as the card is registered to. An alternate delivery address is available if you require.
3.3. When you register you must choose a unique password. Please keep this information safe. As part of our security system our customer service staff can not remind you what your password is. We can send an email reminder to the email address you first supplied us upon registration.
3.4. We reserve the right to decline an application to register by you or to cancel your registration at any time.
4. Basis of the Sale
4.1. Our site invites you to buy products from us. Once you have sent an order to us using the site we will send you an order acknowledgement by email setting out what you have ordered. This is not an acceptance of your order by us. A legally binding contract with you will only arise once we have completed delivering the goods to you as set out below. At this time you become the owner of the goods. This means that you will have no legal liability in connection with your order until delivery is completed.
4.2. We aim to give you a clear idea of the nature of the products we sell. Illustrations, descriptions, and other information are approximate and are for guidance only.
5. Details of the order
5.1. Orders are accepted at our sole discretion but we will normally accept an order if the goods are available, the order reflects current pricing, you are based in the Delivery area and your credit or debit card is authorised for transaction.
6. Price of the goods
6.1. Our charges for transport, packaging and insurance will all be included in the total for the goods at the order confirmation page.
6.2. All prices quoted are British pounds (£) and include Value Added Tax (VAT) at the current rate on all relevant products and services. Prices are updated and changed regularly. Goods are only sold at the price on the site at the time of ordering irrespective of any previous advertised price, or any new price that comes into effect after the order has been placed.
7. Payment Terms
7.1. We will authorise your credit/debit card account for payment upon receipt of order and your card will be charged at the point of ordering, including any delivery charges. We do not accept liability if a delivery is delayed because you did not give us the right payment details.
7.2. We will take all reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide when accessing or ordering from this website, unless this is solely due to our negligence.
8. Out of Stock Items
8.1. Although every care is taken to monitor stock availability, occasionally we may have sold out of an item before we can dispatch it to you. In such cases our customer service staff will contact you with a suggested substitute product if available, or give you the estimated lead time before the item you have ordered will be available again. Any agreement with our customer service staff will have the effect of varying the order you have made. You may request a refund on the unavailable item which you have ordered as an alternative.
9. Delivery & Supply
9.1. The agreement for us to sell and for you to buy the goods you have ordered is made when we deliver the goods to you. Upon delivery you will be invited to check that the goods ordered by you are present in the items being delivered. You will be asked to sign to confirm that you have received all the goods you have ordered. No liability will be accepted for any omission after delivery has taken place.
9.2. We can deliver the goods in two ways:
9.2.1. Collection by you

9.2.2. Delivery by us
220.127.116.11. If you ask us to deliver the goods then we will deliver the goods to the address that you specify in your order. It is important that this address is accurate. As stated above upon delivery you will be invited to check that the goods ordered by you are present in the items being delivered. You will be asked to sign to confirm that you have received all the goods you have ordered. No liability will be accepted for any omission after delivery has taken place.

You may, if you wish, give alternative instructions as to where the goods are to be left, including, but not limited to, instructions to leave the goods unattended and/or unsigned for by you, or signed for by a third party. In these cases we cannot accept liability for any loss or damage to the goods once they have been delivered in accordance with your instructions.
22.214.171.124. We will aim to deliver the goods by the date quoted for delivery, but delivery periods are not guaranteed.
10. Risk and Ownership
10.1. You will own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.
11. Returns & Options To Cancel

12.1. Our products are sold with such statutory warranties as are required by UK law from time to time. Any additional warranty being offered with the product is, unless otherwise stated, offered by the manufacturer of the goods and not by us. You may have to follow any requirements set out by the manufacturer of the goods to benefit from any additional warranty.
13.1. If you have a valid claim in respect of the goods which is based on any defect in their quality or condition or their failure to meet specification in accordance with the contract, and you have returned the goods within 28 days of receipt, you will be entitled to choose either a refund or replacement goods free of charge.
13.2. Delivery cost/charges will not be refunded for any reason other than if you request a replacement of the goods which you have rejected and we are unable to deliver such a replacement.
13.3. These terms and conditions do not affect your statutory rights as a consumer.
14.1. Every effort has, is and will be taken to ensure that the information contained in this site is correct and up to date. The information may from time-to-time become incomplete, inaccurate or out of date. To the full extent permitted by law, but subject to these terms and conditions of sale, we disclaim all warranties and representations (whether implied or expressed) as to the accuracy of any information contained on this site.
14.2. Pictures on the site are intended to present a reasonable representation of the goods being offered for sale but variations in shape, size and colour must be expected. In particular with living products seasonal variations are to be expected and have a greater effect on shape, size, colour and stage of growth.
14.3. We assume no responsibility for the contents of any other websites to which this website has links to or from.
15. Matters out of control
15.1. We will not be liable to you or in breach of the Contract for delay or failure to perform due to a cause beyond our reasonable control.
16.1. All of the written, photographic, design, video and audio content of the website together with the selection and arrangement of it and all software compilations are our copyrighted property or that of the people who have granted to us the right to use it and is protected as such. All rights are reserved.
16.2. None of this material may be used without our written permission. You may download or print a single copy for your own non-commercial off-line viewing.
16.3. All names, logos, slogans, or other phrases may be a trade mark of ours or another person or corporation. Any unauthorised use of trademark is illegal.

18. Changes & Alterations
18.1. We reserve the right to make changes to this website and these terms at any time. Please ensure that you read these terms and conditions every time that you use the site.
19.1. Emails to you will be sent to the address you specify to us. You must only provide us with a valid email address and it is your responsibility to inform us of any changes to that address.
19.2. The headings in these terms are for convenience only and will not affect their interpretation.
20. Governing Law
20.1. This contract is subject to English law and the exclusive jurisdiction of the English courts. To the extent that any provision of these terms is found by a court or competent authority to be invalid, unlawful, or unenforceable, in any jurisdiction, that provision will be deemed not to be a part of these terms, it will not affect the enforceability of the remainder of these terms nor will it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.
